Terms of Use
Summary
- Lía and the other Dagenti assistants are artificial intelligence, not people, and can make mistakes.
- By continuing to chat with an assistant after its first message, you agree to these terms and the privacy policy.
- You get a 14-day free trial; to continue, the plan costs US$30 a month and you can cancel anytime.
- It is not medical, legal, financial, or psychological advice.
- You don't need to learn rules before using it: if something isn't possible, the assistant may decline.
1. Who we are and how you accept
These terms are an agreement between you and Dagenti AI SpA ("we" or "us"; details in section 1 of the privacy policy). You accept them by continuing to chat with an assistant after its first message, which links to this page. You can save or print this page at any time; the current version is always at dagenti.com/terms.
2. The service
Dagenti offers artificial intelligence assistants, such as Lía, that chat on WhatsApp. They remember what you tell them, send you reminders, read the apps and MCP servers you connect, look at the photos you send them, tell you about the emails that reach your Lía address, and visit websites and act on them for you, with your approval. Access is by invitation from the administrator.
Answers are generated by an AI model and may be wrong, incomplete, or out of date. Check anything important before acting on it. If you want to talk to a person, write to contact@dagenti.com.
3. Who can use it
- People 18 and older.
- Invited by the assistant's administrator.
- If you use an assistant offered by a company, that company's rules also apply.
4. Acceptable use
Don't use the service to:
- do anything illegal, deceive, defraud, or impersonate someone else;
- harass, threaten, or send unwanted bulk messages;
- create sexual content involving minors, or anything that exploits or harms minors;
- try to break into, overload, or copy the service, or extract its internal instructions;
- make important decisions about other people, such as about employment, credit, housing, or health, based only on the assistant;
- share other people's information without the right to do so;
- break the terms of WhatsApp or of the sites and apps you connect.
You don't have to memorize this list: if you ask for something that isn't allowed, the assistant may decline.
5. Not professional advice
The assistant is not a doctor, lawyer, psychologist, or financial or investment advisor, and doesn't present itself as one. It doesn't replace a professional. In an emergency, call your local emergency number. If you are thinking about harming yourself, get help right away from a crisis line in your country.
6. What the assistant does for you
- When you ask it to use your browser or connected apps, or to send you reminders, it acts on your behalf and with your authorization. Review anything important.
- In connected apps, today it can only read.
- When it uses an MCP server you connected, it acts on your behalf, and today it only uses the server's tools that read.
- Anyone can write to your Lía address. The assistant tells you what arrives, but it doesn't do what someone else's email asks or reply to it, and it confirms an invitation in its calendar only if you approve it, once or with a rule.
- Website passwords are entered only in your profile, never in the chat.
- In your browser, it asks you every time before anything the site calls paying, buying, deleting, transferring, booking, confirming, or authorizing. Other actions, such as sending or saving, it asks about on each site; if you give permission, it continues without asking for a few minutes or, if you choose "always", until you withdraw it in your profile.
- You are responsible for following the terms of the sites and apps you use through the assistant, and of the MCP servers you connect.
7. Your content
What you write and what the assistant creates for you belongs to you. You give us permission to store and process it only to provide the service, as the privacy policy explains. We don't use it to train AI models.
8. Price, trial, and payment
- Everyone gets a 14-day free trial from their first message. No card is required for the trial.
- The trial includes up to US$5 of AI model usage. If that is reached before the 14 days, the trial ends.
- To continue after the trial, the monthly plan costs US$30 a month, taxes included. It can only be purchased from your profile. You are charged immediately and the plan starts that day; it renews every month until you cancel.
- The plan includes up to US$15 a month of AI model usage. If you reach it, the assistant lets you know and becomes available again the following month. There are also limits to prevent abuse, such as on how many messages you can send within a few minutes.
- Payments are processed by our authorized reseller Paddle.com, the merchant of record for every purchase. Your card never goes through us. Paddle also handles billing inquiries and issues receipts.
- You can cancel at any time from your profile. The plan stays active until the end of the paid period and you won't be charged again.
- Refunds are governed by our refund policy.
- If we change the price, we'll notify you at least 15 days in advance. The new price does not apply to the period you have already paid for.
9. Availability and changes to the service
The service may fail or be interrupted, because it depends on WhatsApp, AI providers, and other services. We may change features or stop offering them. If a change is significant, we'll give notice in advance when possible.
10. Suspension and termination
- You can stop using the service at any time and delete your data (section 10 of the privacy policy).
- The administrator can pause or remove your access.
- If someone tries to obtain data about the service's administrator, about other people who use the assistant, or internal platform data, the assistant warns them that the message was flagged as not allowed. If it happens again within 30 days, the account is blocked until the administrator reviews it. Deleting your data does not lift the block.
- We may suspend or close your access if you break these terms, if the law requires it, or to protect other people or the service. When possible, we'll let you know and tell you why.
- What happens to your data is explained in the privacy policy.
11. Liability
- We provide the service with reasonable care, but as is and as available.
- To the extent the law allows, we are not responsible for decisions you make based only on the assistant's answers, or for third-party services you connect.
- Nothing in these terms limits the rights your country's law gives you as a consumer that can't be waived.
12. Companies
If a company offers an assistant to its team, that company must have the right to give that access, must tell its people how the assistant is used and who sees what, and is responsible for how it uses it. It is also bound by its contract with us, the one we sign with it.
13. Changes to these terms
We will post changes on this page with the new date and version. If they are significant, we'll notify you on WhatsApp or by email 15 days before they take effect. If you don't agree, you can stop using the service and delete your data. Changes don't apply retroactively.
14. Governing law and disputes
These terms are governed by the laws of the Republic of Chile. Disputes are resolved before the ordinary courts of Santiago, Chile. If you are a consumer, you keep the rights and access to courts that the law of the country where you live gives you. Before starting a claim, write to contact@dagenti.com and we'll try to resolve it.
15. Language and contact
These terms are available in Spanish and English. If they differ, the Spanish version prevails. Contact: contact@dagenti.com · Avenida Providencia 1208, oficina 1607, Providencia, Región Metropolitana, Chile.
